Terms of Service

Optima Pools by Desert Springs ("Optima," "we," "us") is a product line of Desert Springs Pools, a Las Vegas, Nevada-based pool builder operating under Nevada Contractor License #0037573. Every Optima pool is designed, permitted, and installed by Desert Springs Group.

You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use of the site. You may not:

• Submit false or misleading information through the configurator or any contact form.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Interfere with or disrupt the website's operation.
• Use the site to send spam, malware, or harmful content.

Quotes Are Estimates. The prices shown in our online configurator reflect our published package and add-on prices at the time of configuration. Final project pricing is confirmed during the site visit and contract phase, and may be adjusted to account for site-specific conditions, permitting requirements, or changes you request.

Site Eligibility. All Optima projects require a site visit to confirm fit. We may decline to proceed with a project if the site does not meet our build requirements (flat lot, accessible, within service area, no unusual sub-grade conditions). If we determine your site is not a fit, we will return your deposit in full.

Permits and Local Requirements. Permit fees are included in the package price. However, soil reports, HOA approvals, surveys, and other location-specific requirements are not included and may be required at your expense.

To reserve a build slot, customers place a refundable deposit through our online configurator. The deposit:

• Holds your build slot in our schedule.
• Triggers a site visit and contract review.
• Is fully refundable if the project does not move forward, for any reason, prior to contract signing.
• Is credited toward the final project cost upon contract signing.

The current deposit amount is $50 and is disclosed at the final step of the configurator before submission.

Construction begins only after a written contract is signed by both parties. The contract supersedes any pricing, scope, or representation made on the website or in the configurator. Read the contract in full before signing — it contains the binding terms of your build, including warranty, change-order procedures, and dispute resolution.

Optima currently builds in the Las Vegas Valley and surrounding metro area. We may decline projects outside our defined service area. Service area boundaries may change without notice.

Warranty terms are specified in your project contract. The standard Optima warranty is provided by Desert Springs Group and covers structural and equipment-related items as detailed in the contract. The warranty does not cover damage caused by misuse, neglect, unauthorized modifications, or third-party work performed on the pool after completion.

Financing is offered through independent third-party lenders, including Lyon Financial. Optima is not a lender, broker, or financial institution. All loan terms, approvals, rates, and eligibility decisions are determined solely by the financing provider and are subject to credit approval. Optima is not responsible for any decisions made by financing providers.

All content on the Optima website — including text, images, graphics, logos, and the Optima brand — is owned by Optima or its licensors and protected by copyright and trademark law. You may not copy, distribute, or use our content for commercial purposes without written permission.

The website and services are provided "as is" without warranty of any kind, express or implied. Project images may show finished builds with optional add-ons not included in the base package. Pricing is subject to change. We reserve the right to update package specifications, add-on availability, and service area at any time.

To the fullest extent permitted by law, Optima and Desert Springs Group are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the website or services. Our total liability for any claim arising from these Terms is limited to the amount you paid us, if any, in the 12 months preceding the claim.

These Terms are governed by the laws of the State of Nevada. Any dispute arising from these Terms will be resolved in the state or federal courts located in Clark County, Nevada.

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of our website after changes are posted constitutes acceptance.
